BOOKING CONDITIONS ….
Upon purchase of the tour package, the terms and conditions set
forth herein become a binding contract between the Purchaser and
Expanding Horizons.
1. ACCEPTANCE OF THE CONTRACT FOR TRAVEL SERVICES
Acceptance of a contract for travel services as a result of the
interactive use of this website occurs when the purchaser's deposit
is received by Expanding Horizons. The purchaser agrees that the
contract is made and is to be performed in the County of
Orange, State of California.
2. REPRESENTATIONS BY PURCHASER
Purchaser represents that tender of payment constitutes purchaser's
representation that the itinerary, and all travel components have
been reviewed and that the itinerary and all travel components contained
therein meet the Purchaser's expectations and requests.
Purchaser acknowledges that no principal/agent
relationship between Expanding Horizons and the Purchaser arises
as a result of purchaser's use of the website or purchase of travel
services and no representations other than those contained on the
website have been made by Expanding Horizons to the purchaser.
3. DEFINITIONS:
a Tour Package. The "PRODUCT" purchased by the Purchaser
from Expanding Horizons which consists of the itinerary prepared
by Expanding Horizons and the vouchers for pre-paid travel services.
b Itinerary. The itinerary is the written travel schedule prepared
by Expanding Horizons listing the scheduled daily activities and
itemizing the travel services purchased, including, but not limited
to, hotel accommodations, pre-paid meals, and pre-paid air, land,
and water transportation, including self-driven vehicles and vehicles
with a driver, sightseeing tours, and prepaid entertainment. In
the event of a difference between the information contained in on
the website and that contained in the itinerary prepared for and
delivered to the Purchaser, the language of the itinerary shall
control.
c Confirmation of Travel Arrangements. Travel Arrangements are not
confirmed until Expanding Horizons has received the required deposits.
d Maps and Photographs. Maps and photographs included in the website
materials are intended to provide general information for the Purchaser
concerning the country visits. Actual routes, destinations, and
services included in tour package as stated in the itinerary, may
differ from the routes shown on maps and may not include the areas
shown by the photographs.
e Vehicles. Vehicles included are the standard type of unit provided
by the supplier of such services at the locations where the service
is provided. Terms "limo", "limousine", "chauffeur-driven
car", or similar language refer only to a vehicle and driver
and do not refer to any specific size of vehicle, type of vehicle,
or level of luxuriousness. The type of vehicle and service involved
may vary from location to location. Specific vehicles or types of
vehicles may be available at an additional cost.
f Hotel Accommodations are classified according to the standards
used at the location involved and do not refer to standards which
may be used at any other locations. All local government room taxes
are included. The hotel accommodations, which are included in the
tour package, as selected by the purchaser from the information
provided by the website, are listed in the itinerary provided through
the use of the website and accepted by the purchaser. Prices are
based on twin accommodations with facilities or single rooms as
selected by the purchaser and priced as provided for in the itinerary
provided through the website and accepted by the purchaser.
g Voucher. Coupons delivered to Purchaser with the Travel Documents
as part of the tour package and which constitute evidence of pre-payment
by Purchaser for various travel services. These vouchers may be
exchanged on arrival for payment vouchers representing the same
services. Expanding Horizons is bound by only the terms,
conditions, and representations, if any, which are contained on
the vouchers it delivers to the Purchaser.
h Transfer. The term "transfer" refers to transportation
from one location to another, generally between airport and hotel
and, unless otherwise specifically stated on itinerary, refers to
a seat in a coach (bus), van type vehicle, or car.
i "Meet and Greet Service". Service provided by a representative
of Expanding Horizons to assist the traveler upon arrival at a specified
destination.
j Sightseeing Excursions. Depending upon the nature of the excursion,
sightseeing will be by boats, motor coaches, or other appropriate
vehicles. Determination of the appropriateness of vehicle shall
be determined solely by the provider of the service.
k Admission Charges. All charges for admission to sightseeing or
other events specifically listed on the itinerary are pre-paid and
included unless otherwise stated.
4. PRICE OF TOUR PACKAGE.
The price of the tour Package includes all of the prepaid travel
services represented by the vouchers provided to the Purchaser,
together with the charges by Expanding Horizons for its services
in preparing the itinerary.
Until payment in full is received from Purchaser,
the cost represented by the vouchers are subject to change, without
advance notice, due to fluctuations in tariff, exchange rates, and
other charges beyond Expanding Horizons' control and may result
in a change of price to the Purchaser
Price does not include charges for passports, visas,
inoculations, expenses in the United States, laundry, liquor, soft
drinks and beverages, cover charges, excess baggage charges, travel
cancellation or interruption, accident, and baggage insurance, expenses
for guides or transportation not included in the itinerary, optional
tours, any items of a personal nature, any items not specifically
listed as included, all international departure taxes, and international
fares.
5. PRICING INFORMATION
Expanding Horizons has no obligation to provide Purchaser with any
information concerning the costs utilized in establishing the price
of the tour package, either before, during, or after the tour is
completed.
6. CANCELLATION BY TRAVELER
After payment has been received and reservation is confirmed, cancellation
by Purchaser of the entire tour package, is subject to a basic cancellation
charge of $100 per traveler or tour participant.
a Cancellation within forty-five (45) days of the scheduled departure
date is subject to a charge of $200 per person in addition to a
basic cancellation charge stated above together with any charges
levied by any of the providers of travel services as cancellation
charges will be added to the cancellation charges made by Expanding
Horizons.
b Purchaser's failure to appear at the time of departure, will result
in a cancellation charge equal to 100% of the tour price
c For cancellation charges levied by airlines, refer to airfare
rules.
7 REFUNDS
a In the absence of exceptional circumstances, no refunds are given
for any unused pre-paid services included in the tour package or
any changes made in the itinerary while en route, included, without
exception, changes in hotel accommodation, sightseeing excursion,
and transportation services. Charges included for services provided
by Expanding Horizons are not subject to refund.
b All requests for refund shall be in writing and addressed to Expanding
Horizons 17581 Irvine Blvd. Suite 212, Tustin, California 92780
within thirty (30) days of Purchaser's return to the United States.
c. Expanding Horizons, in its sole discretion, will determine whether
exceptional circumstance exists in any individual case and determine
the amount of the refund, if any. The decision of Expanding Horizons
is final.
d. A request for refund must be accompanied by a statement setting
forth the claimed exceptional circumstance, the reason for the change
in the itinerary, the change made in the itinerary, the reason for
the failure to utilize the service provided, the item for which
a refund is provided, the item for which a refund is requested,
the unused vouchers, and receipts for the alternative services utilized,
if any.
e. No request for refund will be considered or made while Purchaser
is en route.
8 CHANGES IN ITINERARY BY EXPANDING HORIZONS
a Expanding Horizons reserves the right to make changes in the suppliers
of services included on the itinerary, including changing carriers
and substituting similar hotel accommodations for those designated
in the itinerary, where such are made necessary by circumstances
beyond the control of Expanding Horizons.
b Expanding Horizons reserves the right to cancel any excursion
included in an itinerary, or substitute another excursion for one
listed, should circumstances beyond Expanding Horizons' control
make such actions necessary.
9 CONTRACT BETWEEN CARRIER AND TRAVELER
The airlines concerned are not to be held responsible for any act;
omission or event during the time passengers are not aboard the
aircraft. The passenger tickets in use by the airline when issued
shall constitute the sole contract between the airlines and the
purchaser of these tickets and/or passenger.
10 CUSTOM TOUR PACKAGES
a Through the design of the website, Expanding Horizons has provided
the user with the information necessary to assemble a custom itinerary,
including all available travel elements, based upon the information
and requirements communicated to the website by Purchaser.
b The custom itinerary generated by the website in accordance with
the information and requirements communicated to it by the purchaser
is to be reviewed by Purchaser upon receipt for compliance with
Purchaser's requests and exceptions prior to acceptance by purchase
which is acknowledged with payment by Purchaser for service requested.
c Purchaser's failure to request changes using the website constitutes
Purchaser's representation to Expanding Horizons that the itinerary
meets Purchaser's expectations and requests.
d Payment by Purchaser constitutes absolute confirmation that the
itinerary meets traveler's requests and expectations.
Changes in the itinerary by Purchaser, after payment
is made by Purchaser will result in a service charge for each change
requested of $75 plus any charges levied by any of the providers
of travel services. Also, changes may result in a change to the
tour price.
11 WARRANTY DISCLAIMER
No guarantees or warranties, expressed or implied, are made that
the tour package will meet all of the traveler's expectations.
12 RELEASE
Purchaser releases Expanding Horizons from any and all liability
and responsibility, known or unknown, present or future, for any
and all loss, injury to person, damage to property, or accident,
or which may be the result of any delay or change of itinerary,
or irregularity connected with the tour package purchased, which
is beyond its control, including but not limited to, acts of God,
transportation problems, fire, machinery or equipment malfunction
or failure, government actions, wars, civil disturbances, labor
disputes, riots, thefts, sickness, or weather, and which includes
all expenses or damages, direct or consequential, claimed or sustained
by group organizers, tour participants, or travelers, and waive
their individual rights under Section 1542 of the Civil Code of
California, and waive all claims against Expanding Horizons based
on any claim of negligence by any of the suppliers of services included
in the tour package. This release is binding upon group organizers,
tour participants, travelers, their representatives, heirs, and
assigns.
13 CHOICE OF LAW AND VENUE
a All questions of law in any action based upon any claim of breach
of this agreement shall be determined in accordance with the laws
of the State of California as existing at the time of such action.
b Any action brought by either party based upon any claim arising
under or as a result of this contract or based upon the tour package
of which it is a part, shall be brought in a state court of competent
jurisdiction in the County of Orange, State of California.
c. By utilizing the website, purchaser irrevocably waives all claims
and rights to proceed in the federal district court.
14 INTEGRATED CONTRACT
All agreements, representations, guarantees, warranties, or understandings
between the parties are contained in this agreement and any prior
discussions, negotiations, or understandings not set forth are excluded.
This contract may be modified only in writing, signed by the party
to be charged. Changes in the terms of this contract may be made
only by Expanding Horizons, in writing, at its office in Orange
County, California. No changes may be made through the website.
Neither the travel agent nor any representative or agent of Expanding
Horizons, except as specifically provided, has the authority to
waive, amend, change, modify or vary the terms or conditions set
forth.
15 GENERAL INFORMATION
a Baggage. Questions concerning baggage limitations are to be directed
to the airline concerned. On coach portions of trip, baggage may
be restricted to one bag. All baggage shall be carried at participant's
risk.
b Travel Documents. Travel documents will be sent via 2 day UPS
upon receipt of final payment. Expanding horizons is not responsible
for lost or stolen documents, therefore any re-issuance of documents
may be assessed there full face value.
c Note: Expanding Horizons is not responsible for the provision
of passports or visas. For questions concerning detail of visa requirements
and formalities of obtaining passports and supporting documents
please contact the appropriate consulate. Purchaser is solely responsible
for obtaining necessary travel documents.
d Availability. All requests for reservations are subject to availability.
e Car Rentals. Maximum and minimum age may apply subject to car
rental companies rules. Rates do not include: Overtime charges,
additional driver surcharge, or charges for tolls and gasoline.
Specific models cannot be guaranteed plus airport surcharges and
or one way stopover fees may apply.
f Deposits and Final Payments. A deposit of $100 per person is required
at the time travel arrangements are requested. Final payment of
the total price of the tour package must received by Expanding Horizons
not later than 45 days prior to departure.
g Acceptance of and Fees for late Reservations. Provided that Expanding
Horizons has received full payment for all included services, reservations
for travel arrangements will be accepted up to seven days before
departure. Fees for late
reservations for travel arrangements are not assessed, however,
extraordinary expenses incurred in processing such late billing
will be charged to Purchaser.
h Check-In. Check-In time cannot be guaranteed. However as a general
rule most hotels do not accept check-in prior to 2:00 PM and check-out
before 11:00AM
i Insurance. Baggage, trip interruption and personal accident insurance
covering your entire reservation is strongly recommended.
16 IMPORTANT NOTICE.
Expanding Horizons reserves the right to cancel travel arrangements
prior to departure, in which case, its liability shall be limited
the refund of all monies paid by purchaser.

ARBITRATION PROVISION
Agreement to arbitrate
Any claim or controversy arising out of or relating
to any use of this website, or any agreement resulting from the
use of this web site, including any claims against American Expanding
Horizons, Inc., dba Expanding Horizons, its agents, shareholders,
directors, officers, or employees of the Corporation shall, be settled
and determined by arbitration to be held in the County of Orange,
State of California, United States of America.
Arbitration Agreement - Procedural and
Substantive Rules
Any controversy, dispute or claim arising out of
the use of the web site and/or the interpretation, performance,
or breach of any agreement arising from or resulting from the use
of this web site shall be resolved by binding arbitration, initiated
at the request of the party making the claim.
The parties may utilize the services of any neutral
arbitrator or dispute resolution organization, including, without
preference or limitation, JAMS or the American Arbitration Association,
but the parties are not required to utilize any specific organization,
and shall, in good faith, attempt to stipulate to an arbitrator
or dispute resolution organization.
In the event that the parties are unable to stipulate
to the use of a specific arbitrator or organization, or are unable
for any reason to use any other method of selection contained in
this agreement for the selection of an arbitrator, either party
may petition any court of appropriate jurisdiction to assist in
the process of selecting an arbitrator or organization.
Either party is authorized to have a verbatim record
of the arbitration hearing made by either a stenographic reporter,
a video recorder, an audio recorder or by the use of any other form
of verbatim recording of the proceedings. Any party making a record
using any method of doing so shall, on request by the other party,
make a copy of that recording available to the other party at that
party's cost. There shall be no obligation to deliver a stenographic
transcript unless the party authorizing it to be taken has such
a transcript prepared, provided, however, that the other party may
have such a transcript prepared at its cost. If both parties want
a stenographic transcript prepared, the total cost of such preparation
shall be divided equally between the parties.
The arbitrators shall apply California substantive
law and rules of evidence as set forth in the California Evidence
Code and applicable case law, including hearsay rules, with the
intent that the hearing shall be conducted with the same formalities
and using the same criteria as would be applied in a court of law
or equity in the State of California.
The arbitrators are required to accept any evidence
which is admitted or stipulated to by the parties.
The arbitrators shall have the authority to accept
or reject any contested evidence where there is a conflict in the
evidence as presented but may not refuse to accept any evidence
where there is a lack of contrary evidence, unless the arbitrator
finds that the evidence, and/or its source, is not credible.
The arbitrator shall have the right to grant all
legal and equitable remedies and award all damages, including compensatory
damages, general damages, special damages, and punitive damages,
as provide by California law.
The parties may, after the filing of a request
for arbitration, modify this arbitration provision by a writing,
signed by all parties.
Unless affirmatively waived by the parties at the
time of the hearing, the Arbitrators shall prepare in writing and
provide to the parties an award which shall include a statement
of the factual findings upon which it is based together with the
legal basis for the decision if the legal issues are in dispute.
Unless affirmatively waived by the parties at the
time of the hearing, in addition to a statement of the amount of
damages awarded, the award shall include the computation of the
damages by the arbitrator.
The arbitrators shall not have the power or authority
to commit errors of law or legal reasoning, and the award may be
vacated or corrected pursuant to California Code of Civil Procedure
sections 1286.2 or 1286.6 if any such error is found to exist.
Review of Arbitration Award
In addition, notwithstanding the provisions of
the California Code of Civil Procedure, in the event that either
party believes that the provisions of this arbitration clause have
been violated, including the provisions regarding the introduction
or application of evidence to the result, the aggrieved party may
file a petition with a court of competent jurisdiction for a review
of the alleged error.
In the event of a filing of such a petition for
review, the parties shall produce and the arbitrator shall certify
as correct, and the petitioning party shall provide to the court,
a settled statement of facts regarding the arbitration hearing and
evidence proffered or a verbatim transcript made at the hearing
by a stenographic reporter directly or transcribed from any recording
of the proceedings.
Service of Process in Subsequent Actions
In the event that the prevailing party is required
to file a petition to confirm the arbitration award with the appropriate
court, or a court action is sought to vacate or correct the award
as provided herein, the service of said petition, motion or complaint,
or any subsequent proceedings, may be made by U.S. Mail, postage
prepaid, addressed to the other party at the address set forth in
the arbitration proceedings or, where the party is represented in
the arbitration proceeding by counsel, and no notice of withdrawal
of counsel has been served on the prevailing party, addressed to
that counsel, and, notwithstanding any provision of statutory law
to the contrary, said mailed service shall constitute personal service
on said party and the petitioner shall not be required to obtain
further personal service to subject the respondent to the process
of the court.
In addition, after the initial service of the petition,
motion, or complaint, if both parties, and/or their respective counsel,
have facsimile transmitting and receiving equipment [FAX] available,
transmission by either party and/or counsel of any subsequent documentation
by such means shall be permitted and constitute valid service.
